                   	     ORDINANCE NO. 9827
                  
                  
                   AN ORDINANCE CLOSING AND ABANDONING A SEWER
                   LINE AT 1615 AND 1619 GUNBARREL ROAD FOR THE
                   REPLACEMENT OF A SEWER LINE TO SERVE PRIMROSE
                   SCHOOL DAY CARE CENTER LOCATED AT 1619
                   GUNBARREL ROAD, UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned a sewer line at 1615 and 1619 Gunbarrel Road and 
to
         accept a sewer line easement for the replacement of a sewer 
line
         to serve Primrose School Day Care Center located at 1619 
Gunbarrel
         Road, as shown on plat attached hereto and made a part hereof 
by
         reference:
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. The owner of the Primrose School Day Care Center
                   will convey the sewer easement to the City.
               
                2. The developer/contractor will relocate the sewer
                   line as shown on the attached drawings within
                   the new easement according to City standards.
               
                3. The developer/contractor will plug the existing
                   sewer line.

                4. All construction and testing of the new sewer
                   line will be performed by the
                   developer/contractor and approved, and
                   acceptance of the construction will be subject
                   to the City Engineering Division's on-site
                   inspection.
               
                5. The areas reserved for utility easements must be
                   kept free and clear of all structures.
               
                6. All existing easements are retained.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this 
Ordinance
         shall take effect two weeks from and after its passage as 
provided
         by law.
